In law, is it better to vacate a settlement or start a new case?

Start a new case. If you void the settlement, you have nothing but the original charge. If you start a new case, you have the original charge plus retaliation and probably hostile work environment. You also should remember a settlement is a contract, so you have a common law action for breach of contract--thus, 2 or 3 additional charges that can increase your damages.
